<div class="views-field views-field-body"> <div class="field-content"><p>CC0，是讓權利人拋棄他們對各自著作的財產權利，並盡可能將這些著作釋出到公眾領域 (Public Domain)，而後使用者就可以不再受到任何著作權利的限制。故究竟為什麼美國聯邦政府，要用 CC0 來拋棄其資料集與軟體專案的相關著作權利？</p>
<p>其實，美國聯邦政府的作品，依其著作權法第 105 條，並不能受到著作權利的保護，但這個獨特設計未必能全球適用，故而執事者的處理方式，是類同美國專利及商標局的作法，將所釋出的程式源碼或其他素材，標示以 CC0 進行公眾領域貢獻的宣告，以消弭所有可能產生的爭議。</p>

印尼著作權辦公室 2014 年提出的著作權法修法草案，要求所有在印尼當地的著作權利授權行為，都必須至業管的權責機構進行登錄，此舉對於創用CC 等公眾式、開放式授權條款在當地的衝擊將會是全面與巨大的，在 CC Indonesia 持續的關切與努力後，終於獲得權責機構明確的肯定回覆，那就是在日後的修改提案裡，創用CC 授權條款與其他開放授權條款 (Open Licenses)，將會被列入強制登錄制度的除外名單，因為他們意識到開放授權常建立在無償授權的基礎上，而該法案的修訂理由，主要是希望在商務協議契約裡進行把關，避免權利與義務高度傾斜傷害一般民眾的狀況發生。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>2015 年 7 月 27 日訂定並公告生效的「政府資料開放授權條款－第 1 版 (Open Government Data License version 1.0, OGDL-1.0)」，是一個對使用者非常親善，且鼓勵再行衍生利用的授權模式。只不過，對於公務單位來說，要提供如此大範圍的授權利用，依傳統模式原則上僅有公務人員自行產製的編輯著作，或是採購契約上明定機關取得所有權利的素材，才適合採用 OGDL-1.0 進行公眾授權。</p>
<p>然而，若是在採購、補助之初，即可透過契約附款的方式，明確表示公務機關構，得採非專屬 (non-exclusive)、不可撤回 (irrevocable)、得再轉授權 (sublicensable) 之模式，取得專案相關著作財產權利之授權，且嗣後亦得進行任何目的之利用(for any purpose)，即可將相關素材轉以 OGDL-1.0 授權，亦得以選擇任一組合的創用CC 授權條款，進行後續的公眾釋出！此篇說明實務上進行此方向處理的方法。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>實質來論「權利不變」，並不是一個高度精準的詞彙，因為畢竟採用 CC授權的素材，原則上皆已被允許重製、散布，及公開演播，所以權利人所能掌控的權利範圍，確實有所變動。然而，CC授權屬於「非專屬授權 (non-exclusive)」，意指原權利人嗣後仍得以自行利用這些素材，而不會喪失自主另行授權利用該素材的地位。這樣的彈性方式，從權利提供方開啟了該素材得被多為利用的機會，而現在這股非專屬授權的潮流，也影響到公務機關在權利吸納方面的舉措，進一步從權利吸納方，拓展了許多公務補助素材的應用廣度。從近來的發展可以觀察到，公務機關若能在必要時，改採非專屬授權模式取得授權，有時並不妨礙其後續公務之推展，亦可不限定原始創作者自行深化利用該著作，在該素材需要被廣為流傳的情境下，更是雙贏策略。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>雖然它可能不會成為 Netflix下一部大賣作，這短短 12 分鐘以 CC 授權釋出的 "Meridian"（本文暫譯《子午線》）影片內容將會對美國的電影與電視工程師協會 (SMPTE) 產生重大影響，通過資源共享，來讓開源標準的互動性母帶格式（原文 Interoperable Master Format 縮寫：IMF）在網際網路上更加可用。影片內容本身是又具實驗性又有怪異的劇情，但是當開發者把影片原始檔拿到手上時，這 12 分鐘的內容在未來可能將永遠改變影片內容發布方式。在內容方面，雖然《子午線》採用的是使用限制較多的 CC-BY-NC-ND 授權模式，這代表使用者將不可以改作，亦不能以商業角度來使用相關素材，然而所有創用CC 授權的作品都可以自由地被進行重製與散布，亦包含透過網際網路散布與公開傳輸等公開數位演播的授權範圍，較諸傳統權利人保留所有著作權利 (All rights reserved)，Netflix 願意試水溫的部份採用權利人保留部份權利 (Some rights reserved) 的作法，已經是一大進步！透過使用創用CC 授權條款，Netflix 公司在此計畫用燈光、攝影機還有 Action！邁向夢想中更加創新的世界。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>Creative Commons 四大元素裡的「非商業性 (NonCommercial)」，指的基本原則是，使用該 CC授權作品的利用目的，不能直接涉及商業牟利。正式授權條款法律文字是：「您不得以主要為獲取商業利益或私人金錢報酬的方式，行使依本授權條款第 3 條所授與之權利。」然而，何謂「獲取商業利益或私人報酬的方式」，著實日新月異。CC總部曾於 2009 年間，針對 CC授權條款的使用者對於非商業性的認知做了問卷調查，並發布統計報告。</p>
<p>然而，並不代表所有 CC授權素材的提供者，也都會全然揚棄自己主觀的解讀和見解。Great Minds 在 2016 年 3 月狀告 Fedex，其認為採非商業性元素提供的素材，無論在任何一個流通環結，都不能有使用者因此獲得商業利益，故即使 Fedex Office 協助複印、寄送，皆是依照各中小學區學校教職人員的指示或要求，亦違反了非商業性元素的要求。</p>
<p>此案受到 CC總部與 CC US 高度關切，並聲請向法庭提交法庭之友意見書，期待讓非商業性元素的詮釋，能回到授權條款原撰的體系和脈絡來進行討論。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>創用CC 授權條款的強項，在於透過基礎幾個簡要的授權要素 (License Element)，組合成標準化的授權標章 (Common Deed)，透過這些授權標章，便能夠簡單的讓人了解作品的使用權限，細節則另行詳述於法律條款 (Legal Code) 裡，然不可諱言的，多數的使用者並不會時時注意、刻刻翻閱法律條款的細項，而個案上便會有較主觀的自我解讀。</p>
<p>當授權人與被授權人彼此解讀的落差太大，極端狀況下還是會有少數的司法爭議產生，在 2015 美國哥倫比亞特區聯邦地區法院承審的 Drauglis v. Kappa Map Group, LLC，證實了創用CC 授權條款在司法實務上是可被法院認可且執行的，亦是一個就姓名標示 (attribution) 與相同方式分享 (share-alike) 兩個重要元素，皆進行了司法解讀的重要判決，對未來相類狀況的判斷上，具有相當的影響力。</p>

<div class="views-field views-field-body"> <div class="field-content"><p>Creative Commons 全球合作網絡 (Creative Commons Affiliates) 於亞太地區的成員，於本月 7 月 1 日於知識共享中國大陸團隊的主辦下，假北京懷柔雁栖湖「國家法官學院北京分院」，舉行本年度的 CC 亞太地區會議 (CC Asia Pacific Regional Meeting 2016 )。來自孟加拉、日本、菲律賓、印尼、韓國、蒙古、印度、中國大陸、台灣，及香港共 10 個司法管轄區域的成員，共計 20 餘人參與了此次的會議。與會各地區的代表，都以短講、簡報的方式，更新過去二年間，於各地推廣創用CC 授權的發展與經驗。</p>
<p>目前看來開放資料的發展，各地都獲發展上的捷報，而開放教育資源，依然是各地發展的重要走向，值得注意的是，CC Korea、CC Taiwan，與 CC Philippines的組織變化走向，頗有相似之處，除了創用CC 開放授權，在合縱連橫上也相容了開放源碼、開放資料的跨域及跨團體合作！</p>
