Specify a license; mention it in the readme, update package.json, add the license text etc.
This will most likely require asking the original gist author for permission as well.

As of now, no license means the code is copyrighted and thus not really usable by third parties (see http://choosealicense.com/no-license/ ).

As of yesterday afternoon, because there's no license, I'm using this illegally. :(
Was actually going to post this very issue, until I saw it had already been posted.

Just checked on the original Gist, and it seems @sirprize tried to ask the original author for permission. There has been no response in over a year. :(:(:(
