Terms of Service (ToS) for Companion

Effective Date: June 1, 2024

1. Acceptance of Terms

By accessing or using Companion (the "Bot"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Bot.

2. User Registration

To use Companion, you must have a valid Discord account and have completed the Discord registration process. You must be at least 13 years old to use the Bot, and there are no exceptions to this rule. Accounts found to violate this age restriction will be permanently banned by Discord. By using the Bot, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

3. Data Usage and Sharing

By using Companion, you acknowledge that all interactions are logged and shared with third-party AI service providers, including but not limited to OpenAI, Cohere, and TogetherAI. Data may also be shared with any server that is part of the Bot's functionality, including moderation services that verify content for compliance with community standards (e.g., checking for nudity, inappropriate language, spam, etc.). Data is retained indefinitely in accordance with Discord's policies. You consent to this data usage as part of your use of the Bot.

4. User Rights and Data Access

Access to your data is managed through Discord. You may request information regarding your data through the Discord platform, and any requests for data deletion or modification must comply with Discord's policies and processes.

5. User Conduct

You agree to use Companion in a manner that is consistent with applicable laws and regulations and in accordance with Discord's Terms of Service. You are solely responsible for the content you share while using the Bot and for any consequences arising from your actions. You are prohibited from using the Bot if you are under 13 years of age, and doing so may result in a permanent ban from Discord.

6. Limitation of Liability

To the fullest extent permitted by law, the owner of Companion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or related to your use of the Bot or any third-party services. You acknowledge that AI services may be prone to errors, and any issues arising from the AI's functionality are beyond the control of the Bot or its owner.

7. Modifications to the Terms

The Companion Terms of Service may be updated from time to time. Users will be notified of changes through the GitHub repository where the Bot is hosted. Your continued use of the Bot after any modifications will constitute your acceptance of the updated Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the owner of Companion resides, without regard to its conflict of law provisions. Users are responsible for complying with local laws regarding their use of the Bot.
